Terms of Sale — Sous les Toits de Paris

1. Seller Identification

These Terms of Sale apply to all orders placed on the website souslestoitsdeparis.fr published by:

2. Scope

These Terms of Sale govern exclusively the sale of handcrafted products (concrete and wooden items) by the seller to individual customers (B2C), from France to Metropolitan France, the European Union, and Switzerland.

Placing an order on the website implies unconditional acceptance of these Terms of Sale.

3. Products

The products offered for sale are handcrafted creations made by hand. Due to their artisanal nature, slight variations in colour, texture, or dimensions may exist from one item to another. These variations are part of the product's authenticity and do not constitute a defect.

The photographs displayed on the website are as faithful as possible to the actual products, but are not contractually binding on the seller.

4. Orders

4.1 Placing an Order

Every order is confirmed upon receipt of payment. The seller reserves the right to refuse or cancel any order in the event of a payment issue, product unavailability, or an abnormal order.

4.2 Custom Orders

For custom orders (specific dimensions, engravings, made-to-measure items), additional production time should be expected, as indicated at the time of ordering or on the product page. Custom orders cannot be cancelled once production has begun.

5. Prices

Prices are stated in euros (€) inclusive of all taxes. The seller is not subject to VAT pursuant to Article 293 B of the French General Tax Code; no VAT will therefore be charged.

The seller reserves the right to modify prices at any time. Products are billed at the price in effect at the time the order is confirmed.

6. Payment

Full payment is required at the time of ordering. Payments are secured and processed by Shopify Payments. Accepted payment methods are indicated during the checkout process (credit/debit card, PayPal, etc.).

7. Shipping

7.1 Delivery Zones

The seller ships to Metropolitan France, the European Union, and Switzerland.

7.2 Preparation Times

Preparation times vary depending on the item and are indicated on each product page. For custom orders, additional production time should be expected.

7.3 Estimated Delivery Times

Once the order has been shipped, the estimated delivery times are as follows:

These timeframes are given as estimates and may vary depending on La Poste.

7.4 Shipping Costs

  • Metropolitan France: free shipping on orders over €50. Below this amount, shipping costs are calculated based on the actual parcel weight, in accordance with La Poste's rates.

  • Europe & Switzerland: shipping costs are calculated based on the actual parcel weight, in accordance with La Poste's rates.

7.5 Order Tracking

A tracking number is sent by email as soon as the order is dispatched.

7.6 Risk Transfer

The risk of loss or damage to the products transfers to the customer upon delivery to the customer or to a third party designated by the customer.

8. Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to provide any reason.

To exercise this right, the customer must contact the seller at contact@souslestoitsdeparis.frbefore the deadline expires.

Exception: in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to custom-made or personalised products.

9. Returns and Refunds

9.1 Return Conditions

To be eligible for a return, the item must be in the same condition as received, in its original packaging, accompanied by proof of purchase. Returns must be sent to the following address: 20 Rue du Caire, 75002 Paris.

No return will be accepted without a prior request to the seller.

9.2 Refunds

Upon receipt and inspection of the return, the seller will notify the customer of the approval or rejection of the refund. If approved, the refund will be issued to the original payment method within 10 business days.

If more than 15 business days have passed since the return was approved without receipt of the refund, the customer is invited to contact the seller at contact@souslestoitsdeparis.fr.

10. Legal Warranties

The seller is bound by the following legal warranties:

  • Legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code): 2 years from delivery.

  • Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

In the event of a defective, damaged, or incorrect item, the customer must contact the seller immediately upon receipt at contact@souslestoitsdeparis.fr so that an appropriate solution can be offered.

11. Intellectual Property

All creations, models, designs, and content offered for sale or presented on the website are the exclusive intellectual property of Sous les Toits de Paris. Any reproduction or use without prior authorisation is prohibited.

12. Consumer Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, in the event of an unresolved dispute, the customer may refer the matter free of charge to a consumer mediator:

13. Governing Law

These Terms of Sale are governed by French law. In the event of a dispute, and in the absence of an amicable resolution, the French courts shall have sole jurisdiction.
